- Acceptance: We reserve the right to accept or decline your order (e.g., due to stock unavailability). A contract is formed when we send you an order confirmation email, which includes details of your purchase.
- Order Modifications/Cancellations: You may modify or cancel an order up to 48 hours before the scheduled delivery. Cancellations after this period may incur a fee.
3. Products and Pricing
- Product Descriptions: We strive to accurately describe our products (e.g., vegetables, melons, roots, tubers) and their quality. However, due to the natural variability of produce, appearance may vary slightly.
- Pricing: All prices are listed in GBP and include applicable taxes. We reserve the right to change prices, but the price at the time of order confirmation will apply.
- Substitutions: In case of stock shortages, we may substitute items with products of equal or greater value. If you do not accept substitutions, please note this in your order comments.
4. Weekly Delivery Service
- Delivery Schedule: We offer weekly deliveries to specified areas. Your delivery day will be confirmed during checkout.
- Delivery Requirements: You must provide a safe delivery location (e.g., porch, shed) if you are unavailable to receive the order. We are not liable for loss or damage to items left in a designated safe place.
- Delivery Delays: We aim to deliver on time, but delays may occur due to weather, traffic, or crop issues. We will notify you of significant delays and offer a reschedule or refund if necessary.
5. Payment Terms
- Payment Methods: We accept major credit/debit cards and other specified payment methods.
- Payment Processing: Payment is due at the time of order. Orders will not be processed until payment is confirmed.
- Failed Payments: If a payment fails, we will notify you. Failure to resolve payment within 48 hours may result in order cancellation.
6. Quality and Freshness Guarantee
- We guarantee that all produce is harvested on the day of delivery and meets our quality standards. See our Returns & Exchanges policy for details on resolving quality issues.
7. Intellectual Property
- All content on our website (text, images, logos, trademarks) is owned by Tyninghame Community Farm CIC and protected by intellectual property laws. You may not reproduce, distribute, or use this content without our written permission.
8. Limitation of Liability
- Our liability for losses arising from your use of our services is limited to the total value of your order. We are not liable for indirect losses (e.g., loss of profit, inconvenience, or missed opportunities).
- We are not responsible for delays or failures caused by circumstances beyond our control (force majeure), such as natural disasters, pandemics, or supply chain disruptions.
